Terms & Conditions of Sale and use of this web site

1. THIS CONTRACT is made between Cookequip Ltd of the one part (the seller) and of the other part (the buyer).
a. By ordering from the Cookequip Ltd web site the buyer is accepting these Terms and Conditions in their entirety.
b. The terms of this contract may be changed by Cookequip Ltd at any time, without notice, and the changes will be effective from the date of publication on the web site.

2. Delivery Regions
a. Cookequip Ltd delivers mainly within the UK
b. Deliveries to other destinations are made by special arrangement and are subject to higher delivery charges (see item 5.c. below)

3. Products
a. All items are subject to availability.
b. In the event that we are unable to supply an item we shall notify you as soon as is reasonably possible and offer an alternative where possible. If the alternative offered is unacceptable and you have already paid then we will reimburse your payment in full.

4. Payment
a. All payments for the goods shall be made by the buyer on-line upon ordering by Credit or Debit Card payable to the seller or his lawfully authorised agent. 
b. Credit Card and Debit Card payments are made through the seller's lawfully authorised agents, NOCHEX and/or PAYPAL, who will be responsible for the security of Credit Card payments.

c. Credit Accounts: Some customers may be offered credit terms.  In this case additional terms and Conditions apply: i. The goods remain the property of Cookequip Ltd until full payment is cleared into the Cookequip Ltd bank account.  ii. Cookequip Ltd payment terms are BACS Transfer strictly 30 days from Invoice unless advised otherwise in writing.  iii. Should payment not be made to terms interest shall be payable from the date of the Invoice at 2% per month or part month. Further, Cookequip Ltd reserves the right to appoint collection agents to recover from the buyer the debt in full plus all collection costs, fees and commissions in full.  Additionally, Cookequip Ltd or its appointed agents reserves the right to recover the goods from the buyer and reclaim the full costs of such action from the buyer. 

9. Delivery 
a. I
f you are sending the goods as a gift then we suggest that you tell the recipient to expect a delivery as many of our products are chilled and can only remain in the delivery system for 48hrs. If the recipient has moved or is un-contactable then there is the risk that the food items will go off before we can deliver. A delivery contact telephone number and correct postcode is vital.

b. Delivery Cost - The delivery charges shown are for delivery to any one address.  These are subject to change without notice.

England, Wales & Lowlands/Central Scotland.
Up to 1.25Kg - £7.95
1.25 to 1.5Kg - £9.90
1.5 to 20Kg - £9.90
Over 20kg - £13.50 

Scottish Highlands
Up to 20Kg - £21.50
Then £0.25 per 0.05Kg

Northern Ireland & Isle of Man
Up to 10Kg - £19.99
10 to 15Kg - £26.59
15 to 20Kg - £32.09
20 to 25Kg - £37.59
25 to 30Kg - £41

All perishables will be delivered by our overnight courier service, APC.

Certain delivery days may be affected by public and bank holidays. 

c. Delivery Days 
Our main delivery days are Tuesday to Friday. Please allow up to 10 working days for delivery as the majority of our food products are made to order to ensure to ensure they reach you as fresh as possible.
Where you have stated a prefered delivery date we will do our best to meet it - however in busy times such as Christmas this may not be possible. We will contact you to arrange an alternative date.

d. Delivery Times 
Your goods will be delivered any time between 8am and 5.30pm. Unfortunately, we cannot stipulate the precise time, but most parcels tend to be delivered by 3pm. 
"Just to say thank you for such a fast response. Our goods arrived on Thursday January 8th, fantastic service".

e. Delivery Address 
You can arrange delivery to your workplace or to a neighbour if it’s more convenient. Please note it is not possible to give multiple alternatives for the delivery address. A telephone number must be provided for the delivery address.
We cannot accept responsibility for addresses provided incorrectly. 

f. Leaving Safe 
It is your duty to ensure that your requested delivery date is suitable for either yourself or your gift recipient to accept an order. Ideally, the recipient should be in to receive delivery. 
If you are out, the courier may leave your goods with a neighbour and put a card through your door telling you where it is. If you have specific instructions for leaving safe i.e. in the garage, in porch, with next door neighbour (but not an alternative address), please indicate this in the ‘special delivery instructions’ box at the checkout. 

g. Delivery in rural areas 
If you live in a rural area, or somewhere that is hard to find, you need not worry about the delivery driver not finding you. As our courier, APC, will locate your property using your postcode. As long as this is correct, the driver will have no problem finding you.
Postcodes are essential to get your parcels to their destinations quickly.

h. Packaging 
Extensive tests have been carried out to ensure that your goods stay well within refrigerated temperatures during transit. We ensure that each individual item that you order is carefully packed . Your perishable items are packed with ice packs to keep them cool and placed in a polystyrene box to keep them well insulated to ensure they reach you in perfect condition.  "My unsliced side of Smoked Scottish Salmon arrived very efficiently today - very well packed, with the ice bags still frozen, and looking very appetizing".

Ideas For Recycling Our Delivery Boxes
Our polystyrene boxes are great to keep food and drink cool on picnics, at parties and when you need to defrost your freezer.
Use as planters in the garden, because slugs don't seem to like them.
Grind your polystyrene box up to use as soil conditioner to improve drainage and aeration. 
Line your box with a blanket and use as a cat or dog bed. 
Ask your local primary school or youth club if they would like them for use in art and crafts.
Use them as outside food stores for fruit, vegetables, cheese, eggs, bacon, etc. if your fridge is full. The foods will benefit from the dark and cool temperature, so they will keep for longer.
Use them to protect items in transit, or to store fragile items in a loft or shed.

Occasionally some packages can be delayed or even undelivered by the courier. Please contact us as soon as you have any concerns about your order. The quicker we know the better. We cannot be held responsible for parcels which are undelivered or mis-routed due to incomplete or incorrect addresses given by the customer. 
Faulty or damaged goods must be reported to us within 2 days of delivery. In the event of dissatisfaction with the product supplied the goods are to be returned unopened and in the original packaging within 7 days of delivery and a refund will be sent on receipt by us. 
Please contact us immediately by email or telephone if you are considering returning any items. Return delivery costs are to be paid by the purchaser and we suggest you return the goods by registered delivery as we will not refund returns lost in the post. We will only send a replacement product, upon confirmation that the damaged items have been returned. Perishable goods must have been kept refrigerated from the day of delivery.

10. Insurance 
a. All goods delivered by the seller will be insured against loss during transit up to the point of delivery.

11. Delivery chasing enquiries
a. If the buyer does not receive goods within two weeks of ordering, he must contact the seller by Email, telephone or fax. The seller will then establish the reasons for such delay and report back to the buyer with an explanation as soon as possible.

12. Data Protection
a. The buyer is protected by the Data Protection Act. The seller does not make use of any information provided by buyers or purchasers for any purpose other than his own business. In particular, the seller does not provide information gained to any third party save for his lawfully authorised agent for collection of the purchase price in any case.

13. Bulk Email Policy
a. The seller may from time to time, send to previous buyers information about goods including new products and special offers. If the buyer does not wish to receive such information, he may inform the seller.

14. Retention of Title
a. Goods remain in the ownership of the seller until the point of delivery to the buyer.

15. Disclaimer
a. The Seller shall be released from all obligations under these Terms and Conditions in the event of any cause beyond the Seller’s reasonable control which renders the provision of the web site or service impossible or impractical.
b. The Seller is excluded from all liability for any claims, losses, demands and damages and any other consequential losses arising to person or property from or incidental to the use by the buyer of the goods purchased from the Seller and /or from any defects therein . The Buyer undertakes to exercise proper care in the use of any such goods purchased from the Seller and further indemnifies the seller against any claim for such losses demands and damages occasioned to the person or property of any third party as a result of the use by the buyer or such third party of the goods purchased from the seller. The information on the goods contained on this web site is based on the Seller’s present knowledge and experience and is given in good faith. However, no liability will accrue to the Seller in respect of and action taken by the buyer or any third party in reliance thereon.
d. No waiver by the Seller of any breach of the Contract by the Buyer shall be considered as a waiver of any subsequent breach of the same or any other provision.
e. If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected.
f. Your statutory rights are not affected.

16. Mediation in case of dispute
a. The seller has no specific procedure for mediation but is always conscious of the need, so far as possible, to retain good business relations with buyers and is always prepared to discuss with any dissatisfied buyer problems that may arise and, in appropriate cases, to consider an ex-gratia refund.

17. Food Smoking Courses - Courses must be booked and taken within 12 months of ordering after which they lapse with no refund.  Courses are in high demand so should be boooked early.


18. Applicable law
a. This Contract shall be governed by the law of England and Wales.
